These Terms of Use ("Terms") are a legal agreement between you ("you") and Questar Games ("we", "us", "our") governing your use of the Party Toolbox mobile application and any updates to it (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, non-commercial entertainment, in accordance with these Terms and the rules of the app store you obtained it from.

2. Your content stays on your device

The App is designed to run offline. Any content you enter — such as player names or nicknames, teams, presets, and scores — is created by you, stored on your device, and is your responsibility. You agree not to enter content that is unlawful, infringing, or that violates the rights of others. We do not receive, host, monitor, or moderate this content (we have no servers for it), and you remain solely responsible for it.

3. In-app purchases and the free version

- The App is free to download and includes a free version with certain usage limits. - The App offers a single, one-time "Premium" unlock (a non-consumable in-app purchase, product ID `party.game.toolbox.premium.unlock`) that removes those limits. - In-app purchases are sold and processed by the applicable app store (the Apple App Store). On Android, purchases are not enabled yet ("coming soon"). - Whether you own Premium is read on your device from your app-store account; you can restore a prior purchase from within the App or its Settings. - Payments, billing, refunds, and cancellations are handled by the app store under its terms and applicable law. We do not process payments and cannot issue store refunds directly; please contact the app store for billing or refund requests.

4. Acceptable use

You agree not to:

- copy, sell, rent, sublicense, distribute, or otherwise commercially exploit the App; - modify, reverse-engineer, decompile, or disassemble the App, except to the limited extent that applicable law expressly permits despite this restriction; - circumvent, disable, or interfere with the App's free-tier limits, purchase checks, or security; - use the App for any unlawful purpose or in violation of these Terms or any applicable law.

5. Intellectual property

The App and its name, design, original artwork, and other original content are owned by Questar Games or its licensors and are protected by intellectual-property laws. Except for the license in Section 1, no rights are granted to you.

The App includes third-party assets used under their respective licenses, including:

• DiceBear avatars (engine: MIT; "Lorelei" art style: CC0 1.0),

• Google Noto Emoji (SIL Open Font License 1.1),

• Google Fonts (SIL Open Font License).

Attributions are shown in the App under Settings → Credits & licenses.

6. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

7. Limitation of liability

To the maximum extent permitted by law, Questar Games will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid for the App (including in-app purchases) in the 12 months before the claim, or USD 10. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Termination

These Terms apply until terminated. Your license ends automatically if you breach them. You may end it at any time by deleting the App. On termination, the license in Section 1 ends; Sections 2, 5, 6, 7, 9, 10, and 11 survive.

9. Apple App Store — additional terms

This Section applies when you obtain the App from Apple's App Store and is required by Apple for an app distributed with its own end-user license:

- These Terms are between you and Questar Games only, not with Apple. Apple is not responsible for the App or its content. - Your license to use the App is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by Apple's Usage Rules in the App Store Terms of Service. - Apple has no obligation to provide any maintenance or support for the App. - To the maximum extent permitted by law, Apple has no warranty obligation for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation, and any other claims are our responsibility. - Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer-protection or privacy law. - In the event of any third-party claim that the App or your use of it infringes intellectual-property rights, Questar Games (not Apple) is responsible for the investigation, defense, settlement, and discharge of that claim. - You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. - Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.

10. Governing law

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws rules. You agree that the courts located in Georgia have jurisdiction over any dispute arising out of or relating to these Terms or the App, except where applicable consumer-protection law gives you the right to bring proceedings in your country of residence.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and post the new version at this URL. Your continued use of the App after changes take effect means you accept the updated Terms.
